Terms of Service
Last Updated: October 19, 2026
The agreement between your company and Xtimates when we build and run your system. Xtimates is a brand of Dycern LLC.
1. The agreement
These terms are an agreement between Dycern LLC, an Indiana limited liability company doing business as Xtimates ("Xtimates", "we", "us"), and the company that signs up for our service ("you"). They cover the system we build and run for you, the dashboard at https://app.xtimates.com, what you pay, the guarantee, and how you leave. By ticking "I agree" in onboarding, paying for the service, or using the dashboard, you accept them on behalf of your company, and you confirm you're allowed to.
The Refund and Guarantee Policy (xtimates.com/legal/refund), the Acceptable Use Policy (xtimates.com/legal/acceptable-use), the Data Processing Addendum (xtimates.com/legal/dpa), the AI Terms (xtimates.com/legal/ai-terms) and, if you use them, the Developer Terms (xtimates.com/legal/developer-terms) are part of these terms. The Privacy Policy (xtimates.com/legal/privacy) explains how we handle information. If you also signed an order form or service agreement with us, we read it together with these terms. Where they disagree on price, term or the guarantee, the signed document wins.
2. What we do for you
The service. We build a system on your website that gets you estimates: people in your area asking you for a price and a time. That means your website tuned or rebuilt so visitors ask for a price; your Google presence, including local search and AI search; Facebook, Instagram and Google ads run inside your own ad accounts; tracking so every request is logged with its source; and a dashboard that shows every estimate, every dollar of ad spend and every booked job.
What we don't do. We don't answer your phone, give quotes, sell jobs or do the work. You run the jobs. We don't promise revenue, booked jobs or profit. The only promise we make about results is The 20 Estimate Guarantee, described below and in the Refund and Guarantee Policy (xtimates.com/legal/refund).
Who does the work. Our own team runs your account. We use the providers listed in the Data Processing Addendum (xtimates.com/legal/dpa) to host and run the platform, and we stay responsible for their work.
One company per area. While you're a paying client, we won't take on another company in your trade whose service area overlaps yours. Your area is the set of service areas by trade you enter in onboarding and confirm with us on your first call. If your area is already taken when you sign up, we'll tell you and won't charge you.
3. Your account and the dashboard
Who can have one. A company that hires us, through a person who is at least 18 and allowed to sign for it. The service is for businesses, not for personal or household use.
Roles. The owner can invite team members as admins or members and remove them at any time. You're responsible for who you let in and for what they do. Tell us at support@xtimates.com right away if you think someone got in who shouldn't have.
Keeping it accurate. The dashboard is only as good as what goes into it. You agree to keep your company details current, to connect the accounts the service needs, and to update the outcome of each estimate request as it happens.
Availability. We work to keep the dashboard up, but it can be down for maintenance or for reasons outside our control. Your ads keep running in your own accounts while it is. Numbers that come from Google, Meta and your CRM are only as current and accurate as those platforms make them.
4. Plans and what you pay
| Plan | Price | Per estimate | Term |
|---|---|---|---|
| Monthly | $1,500 a month | $75 per estimate | Ask us how the monthly plan ends. |
| Annual | $15,000 up front (2 months free) | $75 per estimate | One payment a year. Committed for the year after the first 45 days. |
Setup fee. None on the annual plan. On the monthly plan: Ask us on your call. Your ad budget is paid by you, straight to Facebook and Google, in your own accounts. It never passes through us and it isn't part of our fees.
Per-estimate fee. $75 per estimate.
The monthly plan. $1,500 a month, billed monthly. How long it runs and how it ends: Ask us how the monthly plan ends.
The annual plan. One payment of $15,000 covers 12 months of service, which is 2 months free against the monthly price. After the first 45 days, you're committed for the rest of the year.
Site rebuild. If your website can't carry the system, we rebuild it first, once, for $3,500. That's a one-time charge, agreed with you before we start. The Refund and Guarantee Policy (xtimates.com/legal/refund) says when it can be refunded.
Site audit. The standalone website audit at xtimates.com/audit is $149, one time. The audit you get in onboarding is part of the service and is yours to keep even if you cancel.
When you're charged. The monthly fee is charged at the start of each billing month. The annual payment is charged when you sign up and again at each renewal. Estimate fees are billed at the end of each billing month for the estimates counted in that month, after flagged ones have been reviewed. Payments run through Stripe, to the card or bank account on your Billing page. Nothing is charged without a person at Xtimates doing it.
Failed payments. If a payment fails, we'll email you and try again. If it's still unpaid after 10 days we can pause the work and the ads until it's paid. Your dashboard stays open so you can fix it.
Taxes. Our prices don't include sales tax. If tax applies to you, it's added to the invoice.
Price changes. We won't change your price during an annual term or any period you've already paid for. Before a price change takes effect at a renewal, we'll email you at least 30 days ahead.
5. What counts as an estimate
Here is the definition, word for word as it appears on our site: "An estimate is a person who booked an estimate appointment with you or asked you for a ballpark price. A form fill on its own isn't one."
Flagging. If a request on your board isn't a real estimate, flag it in the dashboard within 7 days. We review every flag and you can read our reason. A flagged request that we agree isn't real comes off your count and your bill. A no-show that isn't rebooked within 14 days also comes off.
Yours alone. Every estimate request that comes in through your system is yours. We never send it to another company.
6. What you pay Facebook and Google
It goes straight to them. You pay your ad budget directly to Meta and Google, inside your own ad accounts, on your own payment method. We never hold it, bill it or refund it.
The minimum. Each trade has a minimum monthly ad budget. It's also a condition of the guarantee:
| Trade | Guaranteed estimates | Minimum ad budget |
|---|---|---|
| Coatings | 20 estimates a month | $2,500 a month |
| Roofing | 11 estimates a month | Set on your call |
| Siding | 7 estimates a month | Set on your call |
| Windows | 14 estimates a month | Set on your call |
| Gutters | A set number of estimates a month | Set on your call |
Their rules. Meta and Google have their own terms and can limit, reject or suspend ads or accounts. We follow their rules and work to fix problems, but we aren't responsible for their decisions.
7. The 20 Estimate Guarantee
The promise. Your trade's number of estimates a month in your first 45 days, or every dollar you paid Xtimates back. Both plans carry it. After day 45 there's no guarantee. The numbers are in the table above. Ad spend went to Facebook and Google, so it isn't refunded.
On the monthly plan, if you claim after your second monthly payment: We'll go over it on your call.
When you can claim. Any time in the first 45 days after your ads go live. Click Enact guarantee in your dashboard; it starts a process, not an instant refund. We call within 2 business days to confirm your accounts were connected and you followed the plan, give you a written decision within 5 business days of the call, and send the refund within 10 business days of the decision.
The four conditions. The guarantee depends on four things on your side, shown as four lights on your Guarantee page: your accounts are connected; your ad spend is at or above the agreed minimum; new estimate requests are answered within 1 business day; and outcomes are updated in the last 7 days. The Refund and Guarantee Policy (xtimates.com/legal/refund) has the full rules and is part of these terms.
8. What you do on your end
The four conditions above. Keep your accounts connected, keep at least the minimum going to Facebook and Google, answer new requests within 1 business day, and keep outcomes updated. Your dashboard tells you the day you slip.
Access. Give us the access we need to your website, your Google and Facebook accounts and your CRM, and don't remove it while we're working for you. You can send the connect link to whoever runs those accounts.
Contacting people. When you call, text or email the people who ask you for a price, you're responsible for following the laws on calls, texts and email (including the Telephone Consumer Protection Act, the national Do Not Call rules and CAN-SPAM) and for stopping when someone asks you to.
Playing fair. You agree to the Acceptable Use Policy (xtimates.com/legal/acceptable-use).
9. What you own and what we own
Yours. Your website, your domain, your Google and Facebook accounts, your Google Business Profile, your customer list, the estimate records in your dashboard, and your company's name and logo. They're in your name during the service and stay with you after it. The ad copy, images and pages we make for you are yours to keep once they're paid for.
Ours. The platform, our software, our templates, and the methods we use across clients stay ours. You can use the dashboard while you're a client and for the read-only period after.
What you give us. You let us use your logo, photos, reviews, prices and business details to build and run your system, and you confirm you have the right to give them to us.
10. Cancelling and leaving
How you cancel. Monthly plan: Ask us how the monthly plan ends. Annual plan: after the first 45 days, you're committed for the rest of the year. To leave, start it in your dashboard and we confirm on a quick call.
When it ends. You owe the fees for the service through your last day, and nothing after that.
The annual plan. After the first 45 days you're committed for the rest of the year. The annual payment covers that year and isn't refunded for unused months, except under the guarantee.
What happens next. We pause the ads in your accounts on your last day and remove our access. Your dashboard stays open, read-only, for 30 days so you can export your estimates as a CSV and download your invoices. After that we delete your data as the Data Deletion (xtimates.com/legal/data-deletion) page describes.
What you keep. Your website, your accounts, your ads, your customer list and your audit.
If we end it. We can end the service if you seriously or repeatedly break these terms, or don't pay. We'll tell you in writing first and give you at least 14 days to fix it, unless the problem is illegal or harmful. If we end it for any other reason, we refund the part of any prepaid period you didn't get.
11. Signing up online
Agreeing. When you tick "I agree" in onboarding, we keep a record of which version of these terms you agreed to, when, and from which account, so both of us can show what was agreed.
Card and bank payments. Stripe processes payments on our payment form. We never see or store your full card number.
Chargebacks. Please email support@xtimates.com before disputing a charge with your bank. Most problems are faster to fix directly, and a chargeback on a fee that was earned under these terms can cause us to pause the service.
12. Your information and your customers' information
Your company's information. How we collect and use it is in the Privacy Policy (xtimates.com/legal/privacy).
Your customers' information. The names, phone numbers and addresses of the people who ask you for a price are your customers' information. We handle it only to run your system, under the Data Processing Addendum (xtimates.com/legal/dpa).
13. No promise of results
Results depend on your area, your trade, your prices, your ad budget and how fast you follow up. Any example on our site, including the numbers from a coatings company in Utah, is one company's result. Yours will differ. Apart from The 20 Estimate Guarantee, we don't promise a number of estimates, booked jobs or revenue.
Except as these terms say, the service and the dashboard are provided as is, and we make no other promises about them, to the extent the law allows.
14. Limits on what we owe each other
Indirect losses. Neither of us is responsible to the other for lost profits, lost jobs or indirect losses, to the extent the law allows.
The cap. The most we can owe you under these terms is the fees you paid us in the 12 months before the claim. Refunds under the guarantee are paid in full and don't count against the cap.
Your responsibility. You'll cover us for claims that come from the content you give us to advertise, from your contacting homeowners unlawfully, or from your breaking these terms.
What the limits don't cover. Fraud, or anything the law doesn't let us limit.
15. Changes to these terms
We may update these terms. When we make a change that matters, we'll email you at least 30 days before it takes effect and change the date at the top of this page. A change never raises your price inside a term you've already paid for. If you don't agree with a change, you can cancel before it takes effect.
16. Indiana law and disputes
These terms are governed by the laws of the State of Indiana, without regard to its conflict-of-law rules.
Talk first. If something goes wrong, email legal@xtimates.com and we'll try to fix it with you directly before either of us goes further.
Where. Any dispute that can't be fixed that way is brought in the state or federal courts located in Hamilton County, Indiana, and each of us agrees to those courts. Either of us can use small claims court instead.
- If any part of these terms is unenforceable, the rest stays in force.
- If we don't enforce a term right away, we can still enforce it later.
- You can't transfer this agreement without our written consent. We can transfer it as part of a sale or merger of the business.
- These terms, the policies they name, and any signed order form are the whole agreement between us.
